Agreement
This Rental Agreement (“Agreement”) is made between Wil the Photographer, LLC (“Company”) and the rental customer (“Renter”) and governs the rental of equipment and/or services as described in your order confirmation. By placing an order or taking possession of equipment, the Renter agrees to the following terms and conditions.
Order Confirmation
Agreement becomes active upon confirmation of pricing and availability by Wil the Photographer, LLC via written or electronic communication.
Agent Use
Renter may assign an agent (18+) to pick up, operate, or return equipment. The Renter remains fully responsible for all actions taken by their agent.
Insurance
When Wil the Photographer, LLC is not providing on-site operation, the Renter must maintain insurance coverage for the full replacement value and list Wil the Photographer, LLC as an additional insured.
Security Deposit
A refundable security deposit may be required. It will be returned upon satisfactory return of equipment, minus any damage or repair charges.
Payment Terms
Full payment is due at booking. Additional charges may apply for overtime, damage, or returned checks ($25 fee). Payment arrangements must be pre-approved.
Cancellations
- Cancel before 12 PM the business day prior: up to 50% cancellation fee.
- Cancel after 12 PM the day before: up to 100% charge for the first rental day.
- Rescheduled jobs (e.g., weather): charged actual costs if rescheduled within 3 months. Otherwise, a 25% fee applies.
Refunds
Refunds limited to rental cost. Malfunctions must be reported within 2 hours and via voicemail if no tech is available. Failure to report voids refund eligibility.
Weather Policy
Wil the Photographer, LLC is not responsible for cancellations, damages, or interruptions due to weather. No refunds once equipment has been delivered or picked up.
Photo/Video Consent
Wil the Photographer, LLC may photograph or film events for promotional use unless Renter opts out in writing before rental begins.
Equipment Substitution
Company reserves the right to substitute equivalent or better equipment if the original item is unavailable.
Chargebacks & Disputes
By submitting payment or signing, Renter agrees not to initiate chargebacks without first attempting resolution. Fraudulent chargebacks will be prosecuted.
Permits & Venue Approval
Renter is responsible for obtaining permits, venue approval, and ensuring legal compliance with all equipment use.
Digital Acceptance
Digital signature, payment, or order submission constitutes agreement with the same effect as a physical signature.
Equipment Use
- Follow all provided instructions
- Use equipment in safe, appropriate environments
- Protect from weather, water, sand, etc.
- Secure equipment during transport/setup
Cleaning or damage fees may apply due to improper use.
Equipment Return
Late returns are billed daily. Unreturned equipment after 24 hours without communication is considered stolen. Renter pays full replacement cost and collection/legal fees.
Loss or Damage
Renter is responsible for all damage or loss during rental period, including third-party incidents.
Delivery & Pickup
If delivery/setup is included, Renter must be present during the scheduled time. Missed appointments may incur fees. Renter must provide safe access.
Warranty & Function
All equipment is tested before release. Renter agrees to return it in original condition.
Right of Entry
Wil the Photographer, LLC may access premises to inspect or retrieve equipment. No subleasing or alteration of items without written consent.
Indemnification
Renter assumes all risks and indemnifies the Company from any claims, injuries, or damages related to equipment use.
Copyright Compliance
Rentals may be denied if copyright laws are violated or proper licensing is not provided.
Termination
Wil the Photographer, LLC may terminate this agreement with 24 hours’ notice. Renter must return equipment immediately. Renter is responsible for legal fees related to enforcement.
Assignment
Renter remains liable under this agreement even if they assign or sub-rent the equipment to another party.
Foam Machine Use Disclaimer
Wil the Photographer, LLC rents foam machines only. Foam solution is not provided. Renter is responsible for:
- Purchasing a compatible, non-toxic solution
- Ensuring safety for guests, property, and environment
- Managing allergies or injuries from foam
- Preventing surface damage
Wil the Photographer, LLC is not liable for any harm, injury, or damage from foam use.
Foam Machine Operation Disclaimer
The Renter agrees to:
- Follow all instructions or manufacturer guidelines
- Supervise machine at all times
- Avoid water or electrical hazards
- Keep equipment away from unsupervised children/pets
Wil the Photographer, LLC is not responsible for injuries or damages from misuse or unsafe setup.
Lighting Equipment Disclaimer
Renter is responsible for using proper voltage and secure placement. Company is not liable for electrical faults, overheating, fire, or injury due to misuse.
Non-Slip Mats Disclaimer
Mats are provided as-is and must be inspected and secured by the Renter. Slip resistance is not guaranteed.
Foam Pit Disclaimer
If using a foam containment pit, Renter must ensure safety, drainage, and supervision. Wil the Photographer, LLC is not liable for slipping, water damage, or injury.
