1. PHOTOGRAPHY & RECORDING CONSENT

I voluntarily authorize Wil the Photographer, LLC and its authorized photographers, videographers, representatives, contractors, licensees, successors, and assigns to photograph, film, video record, audio record, or otherwise capture my image, likeness, appearance, voice, and participation.

This authorization may apply to photographs, video, audio, or other media created during photography sessions, events, nightlife events, transportation activities, promotional activities, gatherings, or other activities involving Wil the Photographer, LLC.

2. PERMISSION TO USE MY IMAGE & LIKENESS

I grant Wil the Photographer, LLC permission to reproduce, edit, crop, retouch, adapt, publish, display, distribute, transmit, advertise, promote, license, and otherwise use photographs, video, audio, and other media containing my image, likeness, appearance, or voice for lawful purposes associated with Wil the Photographer, LLC.

Authorized uses may include:

• The Wil the Photographer photo store
• Event photo galleries
• Event recap galleries
• Instagram
• Facebook
• TikTok
• YouTube
• Other social-media platforms
• Website banners and promotional graphics
• Advertising campaigns
• Event advertisements
• Transportation and party-bus promotions
• Digital advertisements
• Email promotional materials
• Flyers
• Posters
• Brochures
• Portfolio materials
• Business presentations
• Editorial and publicity materials
• Commercial advertising for Wil the Photographer, LLC
• Archival and historical documentation

4. FACIAL RECOGNITION & BIOMETRIC INFORMATION

If I voluntarily use a facial photo-search feature, I understand that additional disclosures may be presented at the time of use and that I may be required to affirmatively consent before submitting a selfie or enabling an optional saved face profile.

I understand that facial photo search is intended only to help me locate photographs of myself. Any selfie or other image I submit for facial photo search must depict me, and I may not use the feature to search for another person.

I understand that facial matching is probabilistic and may produce incorrect matches or fail to locate photographs that contain me. Facial photo-search results are provided only as a convenience for locating possible photographs and are not an identity-verification system.

A selfie submitted only for facial photo search will not be treated as a promotional photograph, publication authorization, or commercial media release merely because it was submitted to the search feature.

Where a saved “Photos of Me,” new-photo alert, or temporary live-search feature is offered, a separate face identifier or face vector may be retained for the period disclosed for that feature. Available account controls or a verified privacy request may be used to request deletion where applicable.

Facial information used for the Photo Store is not sold, leased, traded, or provided to unrelated third parties for their own advertising or marketing purposes.

5. OWNERSHIP & COPYRIGHT

I understand that giving permission to use my likeness does not transfer ownership of photographs, videos, recordings, or other media to me.

Unless otherwise agreed in writing, copyright and ownership of media created by Wil the Photographer, LLC remain with Wil the Photographer, LLC or the applicable copyright owner.

6. EDITING & CREATIVE CONTROL

I authorize reasonable editing of the media, including cropping, resizing, retouching, color correction, formatting, captions, graphic design, layout changes, and similar modifications.

Wil the Photographer, LLC will not knowingly alter media in a manner intended to falsely portray me as participating in illegal conduct or create a materially false or defamatory representation of me.

7. NO PRIOR APPROVAL REQUIRED

I understand that I do not have the right to inspect or approve photographs, videos, advertisements, edits, captions, layouts, publications, or other completed materials before they are published or used unless Wil the Photographer, LLC separately agrees otherwise in writing.

8. COMPENSATION

Unless I have a separate written agreement with Wil the Photographer, LLC stating otherwise, I understand that I am not entitled to royalties, residuals, licensing fees, commissions, or other compensation based solely upon the publication, promotion, licensing, distribution, or sale of media containing my likeness.

9. PUBLICITY & PRIVACY RELEASE

To the extent permitted by applicable law, I release Wil the Photographer, LLC and its authorized representatives from claims based solely upon an authorized use of my image, likeness, appearance, or voice consistent with this Release, including claims involving rights of publicity or privacy.

Nothing in this Release waives rights or claims that cannot legally be waived.

10. USE OF MY NAME

Wil the Photographer, LLC is not required to identify me by name when using photographs or media containing my likeness.

If my full name, social-media handle, testimonial, biography, or other identifying information is used, it will be used as authorized by me or as otherwise permitted by applicable law.

11. NO FALSE ENDORSEMENT

This Release does not authorize my likeness to be used to falsely state or imply that I personally endorse an unrelated third-party product, political candidate, political campaign, religious organization, or other unrelated third party.

12. SOCIAL MEDIA & INTERNET DISTRIBUTION

I understand that media published on websites, social-media platforms, advertising networks, or other internet services may be viewed, downloaded, shared, reposted, or otherwise distributed by third parties outside the direct control of Wil the Photographer, LLC.

Wil the Photographer, LLC is not responsible for unauthorized third-party copying or redistribution that occurs after media has been lawfully published.

13. DURATION OF RELEASE

Unless otherwise required by applicable law or agreed in writing, the permissions granted through this Release apply to media created during the event, session, or activity associated with this Release and continue for as long as Wil the Photographer, LLC lawfully owns or controls that media.

14. REQUESTS REGARDING FUTURE USE

Questions or requests regarding future use of media may be submitted to wilthephotographer@gmail.com .

A request concerning future use does not automatically require the recall, destruction, deletion, or withdrawal of media that was lawfully printed, published, distributed, licensed, sold, or incorporated into completed materials before the request, except where applicable law requires otherwise.

15. MINORS

If the individual being photographed or recorded is under 18 years of age, a parent or legal guardian must provide consent and electronically sign the Release on behalf of the minor.

The parent or legal guardian represents that they have legal authority to provide this consent on behalf of the minor.

16. VOLUNTARY CONSENT

I acknowledge that I have had an opportunity to read this Media Release & Consent Form before signing.

I understand the rights being granted and voluntarily consent to the photography, recording, publication, display, promotion, licensing, and other media uses described in this Release.

I understand that any consent required for facial-recognition or biometric processing may be presented separately and that signing this Media Release does not eliminate a separate biometric-consent requirement where applicable law requires one.

17. ELECTRONIC SIGNATURE

I agree that I may execute this Release electronically and intend my electronic signature to authenticate and evidence my acceptance of this Release.

Electronic records associated with this Release may include my signature, name, contact information, form responses, event or session information, submission date and time, IP address, browser or device information, and other audit information recorded by the form system.

These records may be retained to document consent, authenticate this Release, resolve disputes, protect legal rights, and demonstrate the circumstances under which the Release was accepted.

18. PRIVACY

Personal information collected through this Release will be handled in accordance with the Wil the Photographer, LLC Privacy Policy .

If facial-recognition or biometric information is processed in connection with a Photo Store feature, that processing is also governed by the Biometric Information & Facial Recognition Privacy Notice and any separate biometric consent or authorization presented for the applicable feature.

19. SEVERABILITY

If any provision of this Release is determined to be invalid or unenforceable, that provision will be limited only to the extent necessary, and the remaining provisions will continue in effect.

20. ENTIRE RELEASE

This Media Release & Consent Form constitutes the agreement concerning the media and likeness rights granted through this Release unless Wil the Photographer, LLC and the participant enter into a separate written agreement that expressly modifies these rights.

21. GOVERNING LAW

This Release is governed by the laws of the State of Florida.

To the extent permitted by applicable law, disputes concerning this Release will be handled in an appropriate state or federal court located in Orange County, Florida.
