Referral Credits Policy

1. PURPOSE OF THE PROGRAM

The Referral Credits Program is designed to reward eligible customers who personally introduce other customers to products, events, transportation, photography, rentals, or other eligible services offered directly by Wil the Photographer, LLC.

Participation is voluntary.

2. ELIGIBILITY

To participate in the Referral Credits Program, a participant must maintain an eligible account with Wil the Photographer, LLC and comply with this Policy, our Terms and Conditions , and other applicable program rules.

Wil the Photographer, LLC may restrict participation when an account:

• Is suspended or terminated.
• Is associated with suspected fraud or abuse.
• Was created primarily to manipulate the referral system.
• Violates this Policy or other applicable terms.

3. HOW REFERRAL CREDITS MAY BE EARNED

Eligible participants may receive a personal referral link, code, or other identifier associated with their customer account.

Referral Credits may be awarded when another customer uses an eligible referral link or code and completes a qualifying transaction directly with Wil the Photographer, LLC.

The amount of Referral Credits awarded, eligible purchases, qualification periods, promotional rates, minimum purchase requirements, and other conditions may vary by promotion.

Credits are not earned until the applicable referral and transaction satisfy the requirements of the promotion.

4. PERSONAL REFERRAL LINKS

Participants may share their own referral link or referral code with friends, family members, followers, or other individuals who may genuinely be interested in Wil the Photographer, LLC services.

A participant may not represent that they are an employee, official representative, agent, or spokesperson for Wil the Photographer, LLC unless separately authorized in writing.

5. PROHIBITED REFERRAL ACTIVITY

Participants may not:

• Create fake or duplicate accounts to generate credits.
• Refer themselves through another account.
• Use another person’s identity without permission.
• Manipulate purchases, refunds, cancellations, or transactions to generate credits.
• Purchase, sell, or exchange referral activity.
• Use bots, automated systems, scripts, or other artificial methods to generate referrals.
• Misrepresent the products, services, prices, events, or policies of Wil the Photographer, LLC.
• Make false claims about guaranteed discounts, free services, earnings, compensation, or other benefits.
• Impersonate Wil the Photographer, LLC.
• Register domain names, social-media accounts, advertisements, or other properties that misleadingly appear to be operated by Wil the Photographer, LLC.
• Use deceptive, fraudulent, misleading, or unlawful promotional practices.
• Send unsolicited bulk messages, spam, or automated promotional communications on behalf of Wil the Photographer, LLC.

6. SMS, MOBILE NUMBERS & REFERRAL PARTICIPANTS

Participants are not authorized to send SMS or MMS messages on behalf of Wil the Photographer, LLC merely because they participate in the Referral Credits Program.

A referral link or referral relationship does not transfer, assign, or create SMS consent.

Any consent to receive text messages from Wil the Photographer, LLC must be provided directly by the consumer to Wil the Photographer, LLC through the applicable consent process.

Participation in the Referral Credits Program does not automatically enroll a participant or referred customer in any SMS messaging program.

7. NO SALE OR TRANSFER OF CUSTOMER INFORMATION

Referral participants are not purchasing customer leads or customer contact information from Wil the Photographer, LLC.

Wil the Photographer, LLC does not provide a referred customer’s private mobile number, SMS consent record, payment information, password, or other private account information to the referring participant as part of the Referral Credits Program.

Information displayed in a participant’s referral dashboard, if any, may be limited to information reasonably necessary to show referral activity, qualification status, credits, and program performance.

8. CREDIT VALUE

Referral Credits have no cash redemption value unless Wil the Photographer, LLC expressly provides otherwise in writing.

Referral Credits:

• Cannot be withdrawn to a bank account.
• Cannot be converted into cash.
• Cannot be redeemed for cryptocurrency or other monetary instruments.
• Are not legal tender.
• Do not represent money being held on behalf of the participant.

9. REDEMPTION

Referral Credits may be applied only toward eligible purchases directly from Wil the Photographer, LLC through wilthephotographer.com or another checkout method expressly approved by Wil the Photographer, LLC.

Eligible purchases may include certain:

• Event tickets
• Transportation reservations
• Photography products
• Merchandise
• Rentals
• Other qualifying products or services

Certain products, services, fees, taxes, deposits, or promotions may be excluded from Referral Credit redemption.

10. NO CASH PAYOUT

Referral Credits cannot be redeemed, exchanged, or requested as cash.

A participant is not entitled to receive cash in place of unused Referral Credits when an account is closed or the program is discontinued, except where applicable law requires otherwise.

11. TRANSFER RESTRICTIONS

Referral Credits are associated with the account to which they were awarded and are non-transferable unless Wil the Photographer, LLC expressly permits a transfer.

Referral Credits may not be:

• Sold
• Traded
• Gifted
• Assigned
• Transferred to another account
• Combined between accounts without authorization

12. REFUNDS, CANCELLATIONS & CHARGEBACKS

Referral Credits associated with a transaction may be reversed, cancelled, or adjusted if the underlying transaction is:

• Cancelled
• Refunded
• Reversed
• Charged back
• Determined to be fraudulent
• Determined not to satisfy the applicable referral requirements

If Referral Credits associated with a reversed transaction have already been used, Wil the Photographer, LLC may adjust the participant’s Referral Credit balance as reasonably necessary to correct the transaction.

13. SYSTEM ERRORS & BALANCE CORRECTIONS

Referral Credit balances may occasionally be affected by technical errors, duplicate transactions, calculation errors, software bugs, synchronization issues, or other system problems.

Wil the Photographer, LLC reserves the right to correct an inaccurate balance, remove duplicate credits, restore missing eligible credits, or otherwise correct a demonstrable system error.

An incorrect balance displayed because of a technical error does not create a right to credits that were not legitimately earned.

14. EXPIRATION

Referral Credits may be subject to expiration periods disclosed in connection with the applicable promotion or Referral Credits Program.

Where an expiration period applies, the applicable expiration information may be displayed in the participant’s account, promotional materials, program description, or other notice.

15. FORFEITURE

Referral Credits may be revoked or forfeited when reasonably associated with:

• Fraud
• Self-referrals
• Duplicate or fake accounts
• Chargeback abuse
• Automated referral manipulation
• Misrepresentation
• Unauthorized transfer or sale of credits
• Material violations of this Policy

16. PROGRAM CHANGES

Wil the Photographer, LLC may modify the Referral Credits Program, including eligible purchases, promotional credit amounts, earning methods, redemption rules, limits, or other program features.

Material changes may be communicated through the website, account dashboard, email, updated program terms, or another reasonable method.

17. PROGRAM SUSPENSION OR TERMINATION

Wil the Photographer, LLC may suspend or discontinue the Referral Credits Program.

If the program is discontinued, unused credits will be handled according to the applicable program notice and applicable law.

Program termination does not require Wil the Photographer, LLC to convert unused promotional credits into cash except where required by applicable law.

18. NO EMPLOYMENT OR AGENCY RELATIONSHIP

Participation in the Referral Credits Program does not create an employment, independent-contractor, partnership, franchise, agency, joint-venture, or representative relationship between the participant and Wil the Photographer, LLC.

Participants do not have authority to enter into contracts, incur obligations, make guarantees, collect payments, or make binding statements on behalf of Wil the Photographer, LLC.

19. TAXES

Referral Credits are designed as promotional customer benefits; however, the tax treatment of any benefit can depend on the facts, circumstances, value, applicable tax rules, and manner in which the benefit was earned or redeemed.

Wil the Photographer, LLC does not provide tax advice.

Participants are responsible for determining whether Referral Credits or other benefits received through the program have tax consequences applicable to their individual circumstances.

Wil the Photographer, LLC may request tax information or provide tax reporting when required by applicable law.

20. PROGRAM LIMITS

Wil the Photographer, LLC may establish reasonable limits on:

• The number of referrals eligible for credits.
• The amount of Referral Credits that may be earned.
• The amount of Referral Credits that may be redeemed in a transaction.
• Eligible products or services.
• Promotional periods.
• Referral qualification requirements.

21. NO GUARANTEE OF FUTURE CREDITS

Participation in the Referral Credits Program does not guarantee that a participant will receive Referral Credits.

A referral must satisfy the applicable program requirements before credits are earned.

The availability, amount, and terms of future Referral Credit promotions may change.

22. ACCOUNT SECURITY

Participants are responsible for maintaining the security of their account credentials and referral information.

Participants should promptly notify Wil the Photographer, LLC if they believe their account or referral link has been compromised or used without authorization.

23. MISUSE & INVESTIGATIONS

Wil the Photographer, LLC may investigate activity reasonably suspected of violating this Policy.

When reasonably necessary, the Company may temporarily hold credits or suspend referral functionality while investigating suspected fraud, abuse, duplicate accounts, transaction manipulation, or other material violations.

24. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Wil the Photographer, LLC is not responsible for indirect, incidental, special, or consequential losses arising solely from the availability, suspension, expiration, or inability to redeem promotional Referral Credits.

Nothing in this Policy limits liability that cannot legally be limited or excluded.

25. GOVERNING LAW & DISPUTES

This Policy is governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Disputes relating to the Referral Credits Program are also subject to the Terms and Conditions of Wil the Photographer, LLC.

To the extent permitted by applicable law, disputes will be handled in an appropriate state or federal court located in Orange County, Florida.

26. ACCEPTANCE

By voluntarily participating in the Referral Credits Program, you acknowledge that you have read and agree to this Referral Credits Policy.

27. CHANGES TO THIS POLICY

Wil the Photographer, LLC may update this Policy periodically.

When this Policy is materially updated, the “Last Updated” date displayed at the top of this page will be revised.
