AGREEMENT BETWEEN USER AND WILTHEPHOTOGRAPHER.COM

Welcome to https://wilthephotographer.com (the “Site”), operated by Wil the Photographer, LLC (“we,” “our,” or “us”). By accessing or using this Site, you agree to be bound by these Terms and Conditions (“Terms”).

DESCRIPTION OF SERVICES

This Site provides:

Event ticketing
Merchandise sales
Photography and videography services
Equipment rentals

REFERRAL CREDITS & WALLET TERMS

Credits have no cash value and are non-transferable.
Valid only on this site and not on third-party platforms.
Credits are promotional and not taxable.
We may revoke credits at any time for fraud or policy violations.

CANCELLATION & REFUND POLICY

Event Tickets: Non-refundable unless requested in writing 7 days in advance.
Rentals: Refundable with 24+ hours notice; 25% fee if cancelled within 24 hours.
Promotional items and digital downloads are final sale.

DIGITAL MEDIA LICENSE

All media purchases are for personal use only unless a commercial license is obtained.

Permitted: Personal sharing, printing, private use.
Prohibited: Resale, commercial use, uploading to monetized platforms, etc.

DIGITAL DELIVERY & ACCESS

Files are delivered via secure link valid for 7 days. Sharing links is prohibited. Each download purchase allows a maximum of 5 downloads per file. Abuse may result in revoked access.

DIGITAL MEDIA DISCLAIMERS

We make no guarantees regarding file compatibility across devices or software platforms. It is the user’s responsibility to verify compatibility before purchase.

ADDITIONAL LEGAL TERMS

Jurisdiction: Disputes must be handled in Orange County, Florida under Florida law.
Alcohol Waiver: You assume all risk related to alcohol use at our events.
Online Conduct: Harassment or abuse is grounds for removal.
Surveillance: By attending events, you consent to being recorded.
Affiliate Disclosure: Some site links may generate affiliate revenue.
Third-Party Processors: Payment processors like Stripe and PayPal are responsible for transaction handling.
Venue Capacity: Admission not guaranteed if venue is at capacity.
Anti-Fraud: Multiple accounts, referral abuse, or suspicious behavior will result in bans or voided credits.
Security: We use SSL and secure systems but cannot guarantee absolute safety.
No Privacy at Events: Attendees may appear in promotional/resale content.
Typographical Errors: We reserve the right to correct price or listing errors.
Promo Codes: Limited-time use only; may be disabled without notice.
Gift Cards: Cannot be exchanged for cash. Non-refundable.
Subscriptions: Customers are responsible for cancelling before billing cycles renew.
Pre-Sale Risk: Event dates and venues may change without warning.
User Content: You grant us a royalty-free license to use any photos, reviews, or posts submitted to our site.
Service Interruptions: We are not liable for site outages or technical failures.
Event Timeliness: Arrive on time. Missed events or buses are non-refundable.
Behavior in Transit: No illegal substances or violence permitted on our vehicles.
Ticket Transfers: Not allowed without prior written approval.
Assumption of Risk: You understand and accept risks associated with nightlife, including injury, strobe lights, noise, crowds, or intoxicated behavior.
Liability Cap: Our liability is limited to the amount paid for the product or service in question.

SHIPPING POLICY

Physical merchandise is shipped within 5–7 business days. We currently ship within the United States only. Customers are responsible for verifying their address before completing checkout. Lost or undeliverable shipments due to customer error are not refunded.

WAITLIST & OVERSOLD EVENTS

Being on a waitlist does not guarantee access. If an event oversells, the most recent ticket holders may be refunded in full.

SUPPORT RESPONSE TIME

We typically respond to emails within 24–48 business hours. During high-volume periods, response times may be longer.

CHARGEBACK POLICY

Unauthorized chargebacks will result in account termination. We reserve the right to dispute claims using transaction records, license logs, and email correspondence.

FORCE MAJEURE

We are not responsible for delays or cancellations due to acts of God, venue closures, illness, weather, or other factors beyond our control.

LICENSE & INTELLECTUAL PROPERTY

All content is owned by Wil the Photographer, LLC. You may not copy or reproduce materials without permission.

EVENT MEDIA RELEASE

By attending an event, you grant us the right to film and use your image in marketing or resale media. You waive the right to inspect or approve media before it is used.

TERMINATION

We reserve the right to block access or cancel orders for users who violate our terms or policies.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Wil the Photographer, LLC.

CHANGES TO TERMS

We may update these Terms at any time. The effective date will reflect the most recent version.

COPYRIGHT COMPLAINTS (DMCA)

If you believe that any content on this site infringes upon your intellectual property rights, please email us with proof of ownership and a request for removal at: [email protected]
