AGREEMENT BETWEEN USER AND WILTHEPHOTOGRAPHER.COM
Welcome to https://wilthephotographer.com (the “Site”), operated by Wil the Photographer, LLC (“Wil the Photographer,” “we,” “our,” or “us”).
By accessing or using this Site, purchasing products or services, registering for an account, purchasing event tickets, or otherwise using our services, you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, you should not use the Site or purchase products or services through the Site.
DESCRIPTION OF SERVICES
Wil the Photographer, LLC may provide services including:
- Event ticketing
- Event and nightlife transportation
- Photography and videography services
- Digital photography and media sales
- Merchandise sales
- Equipment rentals
- Customer account and order services
Services, availability, schedules, pricing, event details, and features may change without notice.
SMS / TEXT MESSAGE TERMS
Wil the Photographer, LLC may offer customers the opportunity to receive SMS and MMS text messages directly from Wil the Photographer, LLC.
Depending on the messaging program for which you separately opt in, messages may include account notifications, purchase and order information, event information, ticket information, transportation updates, pickup information, schedule changes, customer service messages, and other communications you specifically request or consent to receive.
SMS consent is voluntary and separate from acceptance of these Terms. Accepting these Terms, creating an account, entering your phone number, purchasing a product or ticket, or otherwise using the Site does not by itself constitute consent to receive SMS marketing or promotional messages.
Where SMS consent is requested through the Site, you must affirmatively choose to opt in through the applicable SMS consent mechanism. SMS consent is not a condition of purchasing goods or services.
- Message frequency: Message frequency varies depending on your activity, purchases, events, transportation activity, support requests, and the messaging program for which you opted in.
- Message and data rates: Message and data rates may apply.
- Opt out: Reply STOP to an applicable message to unsubscribe from that SMS messaging program.
- Help: Reply HELP for assistance or contact us using the information provided below.
- Carrier responsibility: Mobile carriers are not responsible for delayed or undelivered messages.
Mobile phone numbers, SMS opt-in information, and messaging consent are not sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.
We may use service providers solely as necessary to operate and support our messaging services. Such providers may process information on our behalf only for purposes related to providing those services and are not authorized to use your SMS consent information for their own marketing or promotional purposes.
SMS consent applies only to communications from Wil the Photographer, LLC for the messaging program to which the consumer directly consented. Consent is not transferred to other businesses, advertisers, affiliates, lead generators, or third-party marketers.

REFERRAL CREDITS & WALLET TERMS
Wil the Photographer, LLC may offer promotional referral credits or account credits to customers.
- Referral credits have no cash value.
- Credits cannot be redeemed or exchanged for cash.
- Credits are non-transferable unless expressly permitted by us.
- Credits are valid only for eligible purchases directly from Wil the Photographer, LLC.
- Credits are not valid for purchases from third-party businesses or platforms.
- Referral credits do not constitute ownership of funds held by Wil the Photographer, LLC.
- We may establish expiration dates, redemption restrictions, or promotional limitations for credits.
- We may revoke, cancel, or adjust credits obtained through fraud, abuse, duplicate accounts, manipulation, chargebacks, refunds, or violations of program rules.
Participation in a referral-credit program does not authorize participants to send SMS messages on behalf of Wil the Photographer, LLC and does not transfer or share any customer’s SMS consent.
CANCELLATION & REFUND POLICY
- Event tickets and transportation reservations: All sales are final and are non-refundable and non-transferable unless otherwise expressly stated by Wil the Photographer, LLC or required by applicable law.
- Missed events or transportation: Failure to arrive at the designated pickup location, venue, or event at the required time does not entitle the purchaser to a refund.
- Rentals: Unless otherwise stated in the applicable rental agreement, rentals may be cancelled with at least 24 hours’ notice. Cancellations made within 24 hours may be subject to a fee of up to 25%.
- Digital products: Digital downloads, photographs, videos, promotional products, and other digitally delivered products are final sale.
Any refund that Wil the Photographer, LLC elects or is required to issue does not create an obligation to provide refunds in other circumstances.
DIGITAL MEDIA LICENSE
Unless a separate commercial license is purchased or provided in writing, digital photographs, videos, and other media purchased from Wil the Photographer, LLC are licensed for personal use only.
- Permitted uses: Personal viewing, personal social-media sharing, personal printing, and other private non-commercial uses.
- Prohibited uses: Resale, sublicensing, commercial advertising, unauthorized commercial use, redistribution for profit, or representing the media as your own copyrighted work.
DIGITAL DELIVERY & ACCESS
Digital files may be delivered through secure download links, customer accounts, cloud storage systems, or other electronic delivery methods.
Download links may expire after the access period stated at the time of purchase. Customers are responsible for downloading and securely storing their purchased files before access expires.
Sharing private download links, bypassing download restrictions, attempting to access another customer’s files, or otherwise abusing the digital delivery system is prohibited.
DIGITAL MEDIA DISCLAIMERS
We do not guarantee that every digital file will be compatible with every device, operating system, application, editing program, printer, or storage service.
Customers are responsible for ensuring they have compatible equipment or software for accessing purchased digital content.
EVENT TICKETS AND ADMISSION
An event ticket or transportation reservation grants only the rights specifically described in the applicable event listing.
Customers are responsible for reviewing event dates, times, pickup locations, age requirements, dress codes, identification requirements, venue policies, and other event-specific information before purchasing.
Venues are independently operated and may enforce their own admission, security, identification, dress-code, behavior, and capacity requirements.
Wil the Photographer, LLC cannot guarantee venue admission when a customer fails to satisfy a venue’s requirements or when circumstances outside our control prevent admission.
AGE AND IDENTIFICATION REQUIREMENTS
Customers are responsible for complying with all age restrictions and identification requirements displayed for an event.
A valid, acceptable, non-expired government-issued identification document may be required by a venue or event operator.
Purchasing a ticket does not override a venue’s age, identification, security, or admission policies.
TRANSPORTATION TERMS
Transportation schedules, pickup locations, departure times, routes, and vehicles may be changed when reasonably necessary because of traffic, weather, vehicle availability, safety concerns, venue operations, law-enforcement activity, or circumstances outside our control.
Passengers are responsible for arriving at the designated pickup location before the published departure time.
Vehicles may depart at the stated time. A passenger who misses a scheduled departure is not entitled to a refund solely because the passenger arrived late.
Illegal substances, weapons, violence, threats, dangerous conduct, harassment, and activity that creates an unreasonable safety risk are prohibited while using transportation services.
We reserve the right to refuse or discontinue transportation for a passenger whose behavior creates a safety risk or materially disrupts the service, subject to applicable law.
ASSUMPTION OF RISK
Events, nightlife activities, transportation, crowded venues, dancing, loud music, lighting effects, alcohol consumption by others, and similar activities may involve inherent risks.
By voluntarily participating, you acknowledge and accept the ordinary and reasonably foreseeable risks associated with the activity, except to the extent liability cannot legally be waived or limited.
ALCOHOL
Customers are responsible for complying with all applicable alcohol laws and venue policies.
Wil the Photographer, LLC does not authorize underage drinking, unlawful possession of alcohol, impaired driving, or any other violation of applicable law.
EVENT MEDIA RELEASE
Photography and video recording may occur at events associated with Wil the Photographer, LLC.
To the extent permitted by applicable law, by voluntarily attending an event where notice of photography or recording is provided, you acknowledge that you may appear incidentally in photographs, video, or other media used in connection with documenting or promoting Wil the Photographer, LLC events and services.
Any separately executed release, waiver, or media agreement will control where its terms differ from this general provision.
ONLINE CONDUCT
Users may not use the Site or our services to engage in unlawful activity, fraud, threats, harassment, abuse, unauthorized access, interference with Site operations, or conduct that violates the rights of another person.
We may suspend or terminate access when reasonably necessary to protect the Site, our customers, our business, or third parties.
PAYMENT PROCESSORS
Payments may be processed by independent payment service providers such as Stripe, PayPal, Square, or other providers made available through the Site.
Those providers may process payment information according to their own terms and privacy policies.
Wil the Photographer, LLC does not authorize third-party payment processors to use customers’ SMS opt-in information or messaging consent for their own marketing or promotional purposes.
VENUE CAPACITY AND THIRD-PARTY VENUES
Admission to an independently operated venue may be affected by capacity, safety rules, venue policies, governmental requirements, emergency conditions, or other circumstances outside our control.
Unless specifically stated otherwise, Wil the Photographer, LLC does not own or control third-party nightlife venues.
ANTI-FRAUD
Fraudulent transactions, unauthorized payment activity, duplicate-account abuse, referral-credit manipulation, ticket manipulation, unauthorized chargebacks, and attempts to circumvent Site security may result in order cancellation, account suspension, loss of promotional credits, or other appropriate action.
ACCOUNT SECURITY
Customers are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their accounts.
You should notify us promptly if you believe your account or payment information has been compromised.
SITE SECURITY
We use reasonable administrative, technical, and organizational measures designed to protect the Site and customer information.
No internet-based system can be guaranteed to be completely secure or available at all times.
TYPOGRAPHICAL AND PRICING ERRORS
We reserve the right to correct typographical errors, inaccurate descriptions, pricing errors, availability errors, or other mistakes appearing on the Site.
If a material error affects an order, we may contact the purchaser with available options or cancel and refund the affected transaction when appropriate.
PROMOTIONAL CODES
Promotional codes may be subject to expiration dates, usage limits, eligibility restrictions, minimum purchases, excluded products, or other conditions.
Promotional codes may not be reproduced, sold, transferred, or used fraudulently unless expressly authorized.
GIFT CARDS AND ACCOUNT CREDITS
Gift cards and promotional account credits are not redeemable for cash except where required by applicable law.
Additional restrictions or expiration rules may apply as disclosed when the gift card or credit is issued.
SUBSCRIPTIONS
If a recurring subscription service is offered, applicable pricing, billing frequency, cancellation terms, and renewal information will be disclosed before purchase.
Customers are responsible for cancelling recurring subscriptions in accordance with the cancellation process disclosed for that service.
EVENT CHANGES
Event dates, times, transportation details, performers, venues, or other event details may change due to circumstances beyond our control.
Any cancellation, rescheduling, credit, or refund rights will be determined according to the applicable event listing, these Terms, and applicable law.
USER CONTENT
If you voluntarily submit photographs, reviews, comments, testimonials, messages, or other content for publication through the Site, you represent that you have the right to provide that content.
Where content is intentionally submitted for publication or promotional use, you grant Wil the Photographer, LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content for the purpose for which it was submitted, subject to applicable law.
SERVICE INTERRUPTIONS
We are not responsible for temporary interruptions caused by hosting failures, network outages, payment processor outages, maintenance, internet failures, third-party services, cyber incidents, or other circumstances beyond our reasonable control.
TICKET TRANSFERS
Event tickets and transportation reservations are non-transferable unless the applicable event listing expressly permits a transfer or Wil the Photographer, LLC provides prior written authorization.
SHIPPING POLICY
Physical merchandise is generally shipped within 5–7 business days unless a different shipping period is displayed at checkout or on the applicable product page.
We currently ship physical merchandise within the United States unless otherwise stated.
Customers are responsible for providing an accurate and complete shipping address. Additional costs resulting from an incorrect address may be the customer’s responsibility to the extent permitted by law.
WAITLIST & OVERSOLD EVENTS
Placement on an event waitlist does not guarantee a ticket, seat, transportation reservation, or admission.
If an event or transportation service is oversold and we cannot honor a valid purchase, we may cancel and refund the affected purchase.
SUPPORT RESPONSE TIME
We generally attempt to respond to customer inquiries within 24–48 business hours. Response times may be longer during holidays, high-volume event periods, emergencies, or periods of unusually high demand.
CHARGEBACKS AND PAYMENT DISPUTES
If you believe a transaction is incorrect or unauthorized, please contact us so we have an opportunity to investigate the issue.
We reserve the right to respond to payment disputes and chargebacks with relevant transaction records, checkout acknowledgments, ticket records, attendance or check-in records, digital download records, account activity, communications, and other evidence associated with the transaction.
Fraudulent or abusive payment disputes may result in account restrictions or termination where permitted by law.
FORCE MAJEURE
To the extent permitted by law, we are not responsible for delays, interruptions, modifications, or inability to perform caused by circumstances outside our reasonable control, including severe weather, natural disasters, government actions, transportation interruptions, venue closures, utility failures, public emergencies, illness, or similar events.
LICENSE & INTELLECTUAL PROPERTY
Unless otherwise stated, the Site and its original photographs, videos, graphics, branding, text, software, designs, and other content are owned by or licensed to Wil the Photographer, LLC and are protected by applicable intellectual property laws.
You may not reproduce, distribute, resell, modify, or commercially exploit protected content without authorization except as permitted by applicable law or an applicable license.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Wil the Photographer, LLC’s liability arising from a particular transaction, product, or service will not exceed the amount paid to Wil the Photographer, LLC for that transaction, product, or service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
TERMINATION
We may suspend or terminate access to the Site, an account, or certain services when reasonably necessary because of fraud, abuse, unlawful activity, security risks, violation of these Terms, or conduct that threatens customers, staff, vendors, or business operations.
GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes arising from these Terms or services provided by Wil the Photographer, LLC will be handled in an appropriate court located in Orange County, Florida.
ENTIRE AGREEMENT
These Terms, together with any policies, waivers, licenses, event-specific terms, or agreements expressly incorporated into a transaction, constitute the agreement between you and Wil the Photographer, LLC concerning the applicable use of the Site, product, event, or service.
CHANGES TO TERMS
We may update these Terms periodically.
When these Terms are materially updated, the “Last Updated” date at the top of this page will be revised.
Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
COPYRIGHT COMPLAINTS (DMCA)
If you believe content appearing on this Site infringes copyright or other intellectual property rights, please send a notice describing the allegedly infringing material and sufficient information for us to identify and review the claim.
