When facial photo search is enabled, photographs in eligible public Photo Store albums may be analyzed so that mathematical facial feature information can be created and associated with the applicable photo for matching purposes. This processing is described in more detail below.

We may use personal information to:

- Operate optional facial photo-search and “Photos of Me” features
- Match a voluntarily submitted selfie against eligible searchable event photographs

SMS / MOBILE MESSAGING PRIVACY
Wil the Photographer, LLC may offer customers the opportunity to voluntarily receive SMS or MMS text messages directly from Wil the Photographer, LLC.
Depending on the specific messaging program for which you separately opt in, messages may include account notifications, order information, ticket information, event information, transportation updates, pickup information, schedule changes, customer service communications, and other communications that you specifically request or consent to receive.
Mobile phone numbers, SMS opt-in information, and SMS messaging consent will not be sold, rented, shared, or provided to third parties or affiliates for their marketing or promotional purposes.
SMS opt-in information and consent are specific to Wil the Photographer, LLC and the messaging program for which the consumer provided consent. SMS consent is not transferred, assigned, or provided to other businesses, advertisers, affiliates, lead generators, or third-party marketers.
Third-party service providers may process mobile information only when reasonably necessary to provide technical, communications, hosting, customer service, security, or other support services on our behalf. These service providers are not authorized to use mobile phone numbers or SMS consent information for their own marketing or promotional purposes.
SMS consent is voluntary. Providing your telephone number, creating an account, purchasing a product or service, or accepting our general Terms and Conditions does not by itself constitute consent to receive SMS marketing or promotional messages.
Where SMS consent is collected through our Site, customers must affirmatively choose to opt in through the applicable SMS consent mechanism. SMS consent is not a condition of purchasing goods or services.

Opting out of SMS messages does not prevent us from communicating with you through other methods when reasonably necessary to complete a transaction, respond to a request, or provide a service that you requested.

EMAIL COMMUNICATIONS
We may send transactional emails relating to purchases, accounts, tickets, transportation, digital downloads, customer service, security, or other services you request.
Where required, promotional email communications will be sent based on applicable consent or other lawful authorization.
You may unsubscribe from promotional email communications using the unsubscribe mechanism provided in the message.
CONTACT FORMS AND CUSTOMER COMMUNICATIONS

For facial photo search, we may use Amazon Web Services (“AWS”), including Amazon Rekognition, as a service provider to process images and mathematical facial feature information for matching, indexing, and deletion operations.
SMS opt-in information and mobile messaging consent are not shared with third parties or affiliates for their own marketing or promotional purposes.
HOW WE SHARE PERSONAL INFORMATION
We do not sell or rent mobile phone numbers or SMS opt-in consent.
We do not sell, lease, trade, or disclose facial feature information or face vectors for third-party advertising or marketing. Facial information may be processed by service providers, such as AWS, only as reasonably necessary to operate the facial photo-search features, maintain security, comply with law, or carry out a request from the individual to whom the information relates.
We may disclose other personal information when reasonably necessary to:
- Process payments
- Complete and fulfill customer orders
- Provide requested products or services
- Deliver communications on our behalf
- Operate and secure the Site
- Prevent or investigate fraud
- Comply with legal obligations
- Respond to lawful court orders, subpoenas, or governmental requests
- Protect the rights, property, or safety of Wil the Photographer, LLC, our customers, or others
For clarity, all categories of sharing described in this Privacy Policy exclude SMS opt-in data and messaging consent for third-party or affiliate marketing and promotional purposes.
REFERRAL CREDITS
We may maintain information related to referral-credit activity, including referral identifiers, referred transactions, account credits, and related fraud-prevention information.
Referral participants do not receive another customer’s mobile phone number or SMS opt-in information through the referral program.
Participation in a referral-credit program does not authorize a participant to send SMS communications on behalf of Wil the Photographer, LLC.
EVENT AND TICKET INFORMATION
When you purchase an event ticket or transportation service, we may collect information needed to process the transaction, identify attendees, provide event information, manage transportation, verify admission, prevent fraud, and maintain transaction records.
PUBLIC GUEST LISTS
For certain events, attendee or purchaser names may be included on a guest list when this practice is disclosed in connection with the applicable event or ticket purchase.
We do not intentionally publish customer mobile phone numbers, billing information, payment information, or SMS consent information as part of a public guest list.
If you wish to request removal of your name from a guest list, contact wilthephotographer@gmail.com. Requests should be submitted as early as possible before the applicable event.
PHOTOGRAPHY, VIDEO, AND EVENT MEDIA
Photography or video recording may occur at events associated with Wil the Photographer, LLC.
Event photographs or video may contain images of attendees and may be retained, displayed, licensed, sold, or otherwise used as permitted by applicable law, event notices, releases, agreements, and our Terms and Conditions.
Where a separate media release or agreement applies, the terms of that agreement will control.
FACIAL RECOGNITION, BIOMETRIC INFORMATION, AND PHOTO SEARCH
Wil the Photographer, LLC may offer an optional facial photo-search feature that helps a person locate photographs that may contain them. Depending on applicable law, facial feature information created or processed for this feature may be considered biometric information, biometric data, or sensitive personal information.
Facial photo search is optional. A person does not need to use facial search in order to browse albums, purchase photographs, attend an event, use transportation services, or otherwise use the Site.
HOW THE FEATURE WORKS
Eligible photographs in published, publicly searchable Photo Store albums may be processed to detect faces and create mathematical facial feature data or face identifiers that are associated with the applicable photo. This allows a later selfie search to identify possible matching photographs.
When you voluntarily submit a selfie for facial photo search, Wil Photo Store temporarily processes the image and sends the necessary image data to Amazon Rekognition for comparison against the searchable face collection. Search results are possible matches only and are not identity verification.
Facial matching is probabilistic and may return an incorrect match or fail to find a photograph that contains you. You should review each result before purchasing or relying on it.
SELFIE RETENTION
For a normal one-time face search, Wil Photo Store is designed to delete the uploaded selfie file and any temporary normalized copy after the search request is processed. We do not use the submitted selfie as a public photograph, advertisement, or promotional image merely because it was submitted for face search.
OPTIONAL SAVED FACE PROFILES AND NEW-PHOTO ALERTS
If you are signed in and separately choose to enable a feature such as “Photos of Me” or new-photo alerts, the Site may create a persistent Amazon Rekognition face identifier or face vector linked to your account. The selfie image itself is still deleted after processing. The saved face identifier is used to compare your profile against newly indexed photographs and provide the requested photo-matching feature.
You may pause alerts without deleting the saved face profile, or you may use the available account control to delete the saved face profile. Deleting the face profile is designed to request deletion of the corresponding stored face vector from the Rekognition collection and remove the associated profile record from Wil Photo Store.
TEMPORARY LIVE PHOTO SEARCH
If a temporary live-event search is offered and you choose to keep the search active, a temporary face identifier may be retained for the session period shown when you use the feature. Wil Photo Store is designed to delete that temporary face vector after the live-search session expires.
FACIAL INFORMATION CREATED FROM EVENT PHOTOS
Facial feature data associated with an event photograph may be retained while that photograph remains eligible for facial search. When a photograph is removed from the searchable facial index, Wil Photo Store is designed to request deletion of the face identifiers associated with that photograph.
CONSENT AND CHOICE
Where facial-search consent is presented, you must affirmatively select the applicable consent option before submitting a selfie. Acceptance of our general Terms and Conditions alone does not constitute consent to submit a selfie for facial search.
The facial-search feature is intended only to help you locate photographs of yourself. The image submitted for a search must depict you.
Facial photo search is a self-search feature only. The selfie or other image you submit for facial photo search must depict you. You may not submit an image of another person or use the facial-search feature to identify, track, locate, investigate, or search for photographs of another person, even if you believe you have that person’s permission.
Where applicable law requires additional notice, consent, authorization, or restrictions before facial information may be collected, created, retained, or used, we may limit or disable facial-search functionality unless those requirements have been satisfied.
NO SALE OR ADVERTISING USE
We do not sell, lease, trade, or use face vectors or facial-search information for third-party advertising. We do not use facial-search results as a government identification system, security credential, credit decision, employment decision, insurance decision, or other eligibility determination.
FACIAL INFORMATION REQUESTS
Depending on applicable law, you may have the right to request access to, deletion of, or information about facial information associated with you. Requests may be submitted using the contact information in this Privacy Policy. We may need to verify the request before acting on it.

DIGITAL MEDIA PURCHASE AND DOWNLOAD DATA
When you purchase digital photographs, videos, or other media, we may maintain records relating to the purchase and delivery of that content.
These records may include purchased files, download activity, download dates, account information, order information, and technical data reasonably necessary to provide and secure digital downloads.
DATA RETENTION
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, maintaining transaction records, complying with legal obligations, preventing fraud, resolving disputes, and enforcing agreements.
Typical retention periods may include:
- Event photography and media: May be retained for approximately five years or longer where needed for archival, licensing, business, or legal purposes.
- Order and transaction records: Retained as reasonably necessary for accounting, tax, payment, fraud, dispute, and legal purposes.
- Contact form submissions: Generally retained for up to six months unless continued retention is reasonably necessary.
- Analytics information: May generally be retained for up to 12 months or according to the applicable analytics provider’s configured retention period.
- SMS consent records: May be retained as reasonably necessary to document consent, opt-out requests, messaging history, and compliance with applicable requirements.
- One-time face-search selfies: Wil Photo Store is designed to delete the uploaded selfie file and temporary normalized copies after the applicable search request is processed.
- Face vectors associated with searchable event photographs: May be retained while the associated photograph remains eligible for facial search and are designed to be deleted from the facial index when that photo is removed from the searchable face index.
- Saved account face profiles: Retained while the user keeps the optional saved face-profile feature active or paused, unless deletion is requested, the account is deleted, or a different retention period is required by applicable law.
- Temporary live-search face vectors: Retained only for the temporary session period displayed for the feature and designed to be deleted after the session expires.
YOUR PRIVACY RIGHTS
Depending on where you live and applicable law, you may have rights regarding your personal information, including the right to:
- Request access to personal information we maintain about you
- Request correction of inaccurate personal information
- Request deletion of certain personal information
- Request deletion of an optional saved face profile or associated face vector where applicable
- Request information about facial information or biometric information associated with you where applicable
- Request information about how personal information is used or disclosed
- Object to or restrict certain processing where applicable
- Withdraw consent where processing is based on consent
- Opt out of certain promotional communications
- Opt out of SMS communications by replying STOP

GLOBAL PRIVACY CONTROL AND OPT-OUT PREFERENCE SIGNALS
Where required by applicable privacy law, we recognize qualifying browser-based opt-out preference signals, including Global Privacy Control (“GPC”), as a request to opt out of the sale or sharing of personal information for the browser or device transmitting the signal.
The effect of an opt-out preference signal may depend on the information available to us and whether applicable law requires us to apply the signal to a particular activity.
DO NOT TRACK
Some web browsers offer a “Do Not Track” setting. Because there is not a universally accepted technical standard for Do Not Track signals, the Site may not respond to traditional Do Not Track signals.

If we offer the ability to sign in using Google, Facebook, Apple, or another third-party authentication service, the third-party service may provide us with limited account information according to the permissions you grant and that provider’s privacy practices.
Your use of a third-party authentication provider is also subject to that provider’s applicable terms and privacy policy.
THIRD-PARTY WEBSITES
The Site may contain links to third-party websites or services.
We are not responsible for the privacy practices, security, content, or policies of websites or services that we do not control. You should review their privacy policies before providing personal information.

PRIVACY OF SMS CONSENT
For avoidance of doubt:
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
All categories of information sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent. SMS opt-in data and consent will not be shared with third parties for their marketing or promotional purposes.
This restriction does not prevent us from using service providers that process information solely as necessary to provide SMS delivery, customer service, security, hosting, or other services on our behalf.
DATA CONTROLLER
