Refund and Returns Policy
Wil the Photographer, LLC
This Refund and Returns Policy (“Policy”) applies to purchases made directly from Wil the Photographer, LLC (“Company,” “we,” “our,” or “us”), including purchases through wilthephotographer.com .
By completing a purchase, you acknowledge that you have had an opportunity to review this Policy and agree to the refund, cancellation, transfer, and return terms applicable to your purchase.
Except where expressly stated in this Policy, an applicable written agreement, an event-specific policy, or where otherwise required by applicable law, purchases from Wil the Photographer, LLC are final and non-refundable.
1. EVENT TICKETS
Event ticket sales are final, non-refundable, and non-transferable unless the applicable event listing expressly states otherwise or Wil the Photographer, LLC provides written authorization.
Refunds will not ordinarily be provided because of:
- Change of plans.
- Failure or inability to attend.
- Arriving late.
- Missing transportation.
- Missing an event.
- Failure to bring acceptable identification.
- Failure to satisfy an event’s age requirements.
- Failure to comply with a venue’s dress code.
- Removal from an event or transportation service because of prohibited behavior.
- Personal dissatisfaction when the purchased service was substantially provided as described.
2. TRANSPORTATION RESERVATIONS
Transportation reservations associated with events are final and non-refundable unless otherwise expressly stated.
Customers are responsible for reviewing pickup locations and departure times and arriving before the scheduled departure.
Missing a scheduled bus, vehicle, pickup, or departure does not create a right to a refund.
3. VENUE ENTRY
Many events promoted or serviced by Wil the Photographer, LLC involve independently operated venues.
A ticket purchase does not override a venue’s rules concerning:
- Age requirements
- Identification
- Dress code
- Security screening
- Behavior
- Capacity
- Admission decisions
A customer who is denied admission because the customer does not satisfy a disclosed venue requirement is not ordinarily entitled to a refund.
4. EVENT CHANGES
Event details may occasionally change because of venue operations, performers, weather, transportation conditions, governmental requirements, safety concerns, or other circumstances.
A reasonable change to a venue, schedule, transportation detail, performer, program, or other event component does not automatically entitle a customer to a refund.
If Wil the Photographer, LLC cancels a purchased service and does not provide the purchased service, a reasonable substitute, rescheduled service, or other agreed resolution, the affected transaction will be handled according to the circumstances and applicable law.
5. SOLD-OUT OR OVERSOLD EVENTS
If Wil the Photographer, LLC cannot honor a valid ticket or reservation because an event or transportation service was oversold, we may cancel the affected purchase and issue a refund of the amount paid for the affected item.
6. DIGITAL PHOTOGRAPHS, VIDEOS & DOWNLOADS
Digital products are final sale once download access or digital delivery has been provided.
This includes:
- Digital photographs
- Event photographs
- Digital photo albums
- Videos
- Downloadable files
- Other electronically delivered media
Because digital products cannot ordinarily be physically returned after delivery or access, refunds or exchanges are generally not available after access has been granted.
Nothing in this section limits rights that cannot legally be waived under applicable law.
7. DIGITAL DELIVERY PROBLEMS
If a purchased digital product cannot be accessed because of a technical delivery problem, contact Wil the Photographer, LLC so we can investigate.
When appropriate, we may:
- Restore access.
- Provide a replacement download link.
- Correct a defective file.
- Provide another reasonable resolution.
A technical delivery issue does not automatically require a refund if the purchased digital product can be successfully provided.
8. PHOTOGRAPHY & VIDEOGRAPHY SERVICES
Payments for photography or videography services are subject to the terms disclosed at booking and any applicable written service agreement.
Payments, retainers, booking fees, or deposits identified as non-refundable at the time of booking remain non-refundable except where required by applicable law.
9. EQUIPMENT RENTALS
Equipment rentals are governed by the applicable Rental Agreement.
The general all-sales-final event policy does not replace specific cancellation, rescheduling, security-deposit, malfunction, or rental terms contained in an applicable Rental Agreement.
Where the applicable Rental Agreement provides cancellation or adjustment rights, those rental-specific terms will control.
Charges for equipment damage, loss, cleaning, late return, extended rental periods, missing accessories, or other rental obligations are not refundable merely because the underlying rental period has ended.
10. PHYSICAL MERCHANDISE
Unless a product listing or applicable law states otherwise, physical merchandise sold by Wil the Photographer, LLC is final sale and is not eligible for a return, cash refund, credit refund, or exchange.
Customers should review product descriptions, sizes, quantities, and shipping information before completing a purchase.
If you receive an incorrect item or an item materially damaged before delivery, contact us as soon as reasonably possible so we can investigate and determine an appropriate resolution.
Nothing in this section limits any return, replacement, refund, or other remedy required by applicable law.
11. PROMOTIONAL ITEMS
Promotional products, complimentary items, discounted promotional offers, and items identified as final sale are not eligible for cash refunds or exchanges unless otherwise expressly stated or required by law.
12. REFERRAL CREDITS
Referral Credits are promotional site credits and are governed by the Referral Credits Program Terms .
If a transaction that generated Referral Credits is refunded, reversed, cancelled, charged back, or determined to be fraudulent, associated Referral Credits may be reversed or adjusted.
13. STORE CREDIT
Wil the Photographer, LLC may issue store credit when expressly permitted by this Policy or when we elect to provide a customer-service accommodation.
Unless otherwise stated when issued:
- Store credit is valid for 12 months from the date of issue.
- Store credit is not redeemable for cash.
- Store credit cannot be withdrawn to a bank account.
- Store credit is non-transferable unless we expressly authorize a transfer.
Issuing store credit in one situation does not create an obligation to issue store credit in other situations.
14. TICKET TRANSFERS
Tickets and transportation reservations are non-transferable unless:
- The applicable event listing expressly permits transfers; or
- Wil the Photographer, LLC provides prior written authorization.
An unauthorized resale, transfer, screenshot, copy, or duplication of a ticket does not guarantee admission.
15. UNAUTHORIZED TICKET RESALE
Wil the Photographer, LLC does not guarantee tickets obtained through unauthorized third-party resale transactions.
Customers assume the risk of purchasing tickets from a person or platform not authorized by Wil the Photographer, LLC.
16. COUPONS & PROMOTIONAL CODES
Coupons, discounts, and promotional codes have no cash value unless expressly stated otherwise.
If an order is adjusted or refunded, the value of a coupon or promotional discount is not separately refundable as cash.
17. PAYMENT PROCESSOR FEES
Where a refund is authorized, the amount and method of the refund may depend on the original transaction, payment processor rules, applicable fees, and applicable law.
A refund will not exceed the amount actually paid for the affected item or service.
18. CHARGEBACKS & PAYMENT DISPUTES
If you believe a transaction is incorrect, unauthorized, duplicated, or otherwise problematic, please contact Wil the Photographer, LLC so we have an opportunity to investigate and attempt to resolve the issue.
Nothing in this Policy prevents a customer from exercising a payment-dispute, chargeback, or consumer right that cannot legally be waived.
Wil the Photographer, LLC reserves the right to respond to payment disputes with relevant evidence, which may include:
- Order and transaction records
- Checkout acknowledgments
- Electronic-signature records
- Event ticket records
- QR-code scan records
- Check-in records
- Transportation records
- Digital download records
- License acceptance records
- Customer communications
- Billing information
- Payment information permitted to be disclosed by the payment processor
- IP address and device information where lawfully collected
- Other records relevant to the transaction
Fraudulent, knowingly false, or abusive payment disputes may result in account restrictions or other remedies permitted by applicable law.
19. FRAUD
Refunds, credits, replacements, and adjustments may be denied when a request is reasonably associated with:
- Fraudulent activity
- Unauthorized account access
- Duplicate-account abuse
- Referral-credit manipulation
- Ticket duplication
- False claims concerning delivery or attendance
- Other material violations of our policies
20. WEATHER
Weather conditions alone do not automatically create a right to a refund.
Events and transportation may continue, be delayed, modified, relocated, or rescheduled when reasonably appropriate.
If weather makes performance impossible or unsafe, the applicable event, transportation, rental, or service terms will determine the available resolution, subject to applicable law.
21. FORCE MAJEURE
To the extent permitted by law, Wil the Photographer, LLC is not responsible for delays, interruptions, modifications, or inability to perform caused by circumstances outside our reasonable control.
Such circumstances may include:
- Severe weather
- Natural disasters
- Hurricanes
- Flooding
- Public emergencies
- Governmental actions
- Venue closures
- Utility failures
- Transportation interruptions
- Labor disruptions
- War or civil disturbance
- Internet or service-provider failures
- Other circumstances outside our reasonable control
22. THIRD-PARTY VENUES & SERVICE PROVIDERS
Wil the Photographer, LLC is not responsible for refunding amounts solely because an independently operated venue or third-party provider enforces its own lawful policies when the purchased Wil the Photographer, LLC service was otherwise provided as described.
Venue admission remains subject to applicable identification, age, capacity, dress-code, security, and behavior requirements.
23. CUSTOMER RESPONSIBILITY
Customers are responsible for reviewing the information associated with a purchase before completing checkout, including where applicable:
- Product or service description
- Event date
- Event time
- Transportation departure time
- Pickup location
- Age requirement
- Identification requirement
- Dress code
- Ticket quantity
- Digital-media license
- Rental terms
- Refund terms
24. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Wil the Photographer, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from a customer’s inability to attend an event, missed transportation, third-party venue decisions, or other circumstances described in this Policy.
Nothing in this Policy excludes or limits liability that cannot legally be excluded or limited.
25. REQUESTING REVIEW OF A TRANSACTION
If you believe an order requires review because of a billing error, duplicate transaction, digital-delivery problem, cancellation by Wil the Photographer, LLC, or another qualifying issue, contact us with:
- Your full name
- Order number
- Email address associated with the order
- Description of the issue
- Any relevant supporting information
Submitting a request does not guarantee that a refund will be approved.
26. REFUND METHOD
When a monetary refund is approved, we will generally attempt to return the approved amount to the original payment method.
Processing time after a refund is submitted may depend on the customer’s bank, card issuer, payment processor, or other financial institution.
27. CHECKOUT ACKNOWLEDGMENT
Customers are required to acknowledge this Refund and Returns Policy before completing checkout where the acknowledgment is presented.
By selecting the acknowledgment checkbox and submitting payment, the customer confirms that the customer had an opportunity to read and accepts the refund and final-sale terms applicable to the purchase.
28. ELECTRONIC ACCEPTANCE RECORDS
Wil the Photographer, LLC may maintain electronic records documenting a customer’s acceptance of this Policy.
Records may include:
- Order number
- Customer name
- Acceptance status
- Date and time
- Policy version
- IP address where lawfully collected
- Browser or device information
- Electronic signature where applicable
These records may be used to administer transactions, provide customer support, prevent fraud, respond to disputes, and document the terms accepted at checkout.
29. TERMS AND CONDITIONS
This Policy should be read together with the Terms and Conditions of Wil the Photographer, LLC.
If an applicable written Rental Agreement, event-specific policy, service agreement, or other expressly incorporated agreement contains more specific refund or cancellation provisions, the more specific provisions will control for that transaction to the extent permitted by applicable law.
30. GOVERNING LAW
This Policy is governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes concerning this Policy will be handled in an appropriate state or federal court located in Orange County, Florida.
31. POLICY UPDATES
Wil the Photographer, LLC may update this Policy periodically to reflect changes in our products, services, business practices, or legal requirements.
When this Policy is materially updated, the “Last Updated” date displayed at the top of this page will be revised.
